Federal law dictates that firearms cannot be shipped directly to a consumer’s home; they must be transferred through a Federal Firearms License (FFL) holder.
- FFL Requirement: All firearms, receivers, and serialized parts must ship to a valid FFL dealer.
- Transfer Process: The buyer is responsible for selecting an FFL and ensuring they provide a copy of their license to the manufacturer before shipping.
- Background Checks: Sales are contingent upon the buyer passing a NICS background check and completing ATF Form 4473 at the FFL location.
- Fees: Clearly state that any FFL transfer fees or state-specific background check fees are the buyer’s responsibility and are typically non-refundable.
Compliance & Eligibility
- Age and Eligibility: Require customers to certify they are at least 18 (for long guns) or 21 (for handguns) and are not prohibited from possessing firearms under Ark. Code Ann. § 5-73-103 (e.g., prior felonies or mental health adjudications).
- Prohibited Persons: Users must warrant they are not legally prohibited from possessing firearms (e.g., no felony convictions, dishonorable discharge, or active restraining orders).
- Jurisdictional Restrictions: Maintain a list of “prohibited states” or jurisdictions where you will not ship specific items, such as high-capacity magazines or certain firearm types.
Limitation of Liability & Immunity
- Misuse Clause: Explicitly state the manufacturer is not liable for damages resulting from the criminal or unlawful misuse of the product.
- Installation: Require that all parts be installed by a qualified gunsmith or certified armorer to maintain safety and warranty.
- Indemnification: The user agrees to indemnify the manufacturer against claims arising from their improper or illegal use of the product.
Returns, Warranty & Shipping
- ALL FIREARM SALES are FINAL
- Manufacturer Warranty: only covers workmanship, not “normal wear’ or “misuse”
- Risk of Loss: Define that the risk of loss passes to the buyer once the product is delivered to the carrier or the FFL.
Intellectual Property & Site Use
- Content Ownership: All site graphics, logos, and text are protected property.
- Prohibited Acts: Ban the use of automated “robots” or “spiders” to scrape site data.
